I keep hearing that the existing CC&Rs are “outdated” or that without new CC&Rs we will not be “taken seriously”. How exactly are new CC&Rs going to legitimize us? The existing CC&Rs have stood the test of time and despite their age they seem to be serving our beautiful neighborhood just fine.
Is there a safety issue regarding the need for a firebrake? Probably. Does the need for a firebrake mean that we have outdated CC&Rs? Is our only cure a lengthy set of untested CC&Rs?
Despite all of the Board’s emotive vocabulary, I have yet to hear any particularized reason why our CC&Rs are outdated or how anyone but themselves will be taken more seriously by new CC&Rs. That’s not to vilify the Board (I’m sure they are sincere in their service to our community), but I just don’t think they’ve really thought this through.
The power to drag a member of our neighborhood into court for not bending to the will of the Board is a power that is not necessary for our neighborhood. Label them”outdated”, label them as “not being serious”, hell call it “a need to reflect our current safety concerns”, but the vast majority of problems are best solved through neighborly communication, not through pages upon pages of HOA rules, unspecified HOA fees, and the power to place liens on our property.
The existing CC&Rs are serving our community just fine. Please join me at the meeting to come up with ideas on how to address the fire issue facing our community. We can solve this – and MANY other problems – without collectively eroding our property rights. Stand with me in telling the Board that we don’t need new CC&Rs. We need solutions.
